Nails by Olivia ("we", "us", "our") is a small, independently run business based in Blackpool, United Kingdom, selling hand-painted press-on nail sets via www.nailsbyolivia.co.uk (the "Site"). By placing an order through the Site or via WhatsApp, you ("you", "the customer") agree to be bound by these Terms & Conditions in full.
All prices on the Site are shown in GBP (£) and are inclusive of any applicable taxes. Payment for standard listed sets is taken in full at checkout via PayPal. A contract between you and us is only formed once payment has been successfully processed — an item in your basket is not reserved for you until payment completes.
We reserve the right to correct any pricing or listing errors on the Site at any time before an order is accepted, and to decline or cancel an order placed as a result of an obvious pricing or description error, with a full refund.
Custom Set and Solid Custom Colour listings are ordered by contacting us directly via WhatsApp. No payment is taken through the Site for these — price, design, size, shape and length are agreed directly with you over WhatsApp, and that agreed price is binding once you confirm it and payment is made by the method we specify at the time.
Custom designs are created based on your description and any reference images you provide. We will always confirm the design concept with you before starting work, but hand-painted artwork is inherently unique — minor variation between a reference image and the finished, hand-painted result is normal and is not a fault.
Every named set listed on the Site (e.g. Harvest Glow, Dark Truffle, Lacework and similar) is a genuine one-off — we hold exactly one of each. Stock is allocated strictly on a first-completed-payment basis. Once a set has been purchased, it is immediately marked as sold and removed from sale; it will not be recreated or restocked. Adding an item to your basket does not reserve it, and in the rare event two customers attempt to buy the same one-off item at the same moment, only the first successful payment will be honoured — the other customer will not be charged.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day cancellation ("cooling-off") period that applies to most online purchases does not apply to goods made to a consumer's specification or which are clearly personalised (Regulation 28(1)(b)).
Every set we sell — including the eight named one-off sets — is hand-painted specifically to fulfil your order, and Custom Set / Solid Custom Colour orders are personalised to your exact specification (size, shape, length, colour and design). As such, once we have begun painting your order, it cannot be cancelled for a change of mind, and no refund will be given on that basis. This does not affect your separate statutory rights if an item arrives faulty, damaged or not as described — see Section 7.
Because every set is hand-painted to order, please allow up to 3–7 working days from cleared payment for your set to be completed and dispatched. During busy or seasonal periods this may take slightly longer — we will let you know if so.
It is your responsibility to provide a complete and accurate delivery address at checkout. We are not responsible for orders that fail to arrive, or that are delayed, due to an incomplete or incorrect address supplied by you — a reshipment in this case may be chargeable.
We post via Royal Mail / a tracked courier service. Once a parcel has been handed to the courier, delivery timing and safe transit are outside our direct control. If your order has not arrived within 10 working days of dispatch, please contact us and we will raise it with the courier — we ask that you allow the courier's standard investigation period to run before we can offer a reshipment or refund, in line with the courier's own claims process.
As every set is made to order and personalised (see Section 5), we do not offer returns or refunds for change of mind, incorrect size chosen by you, or a design you simply no longer want once your order has been painted.
Your statutory rights under the Consumer Rights Act 2015 are not affected. If your set arrives genuinely faulty, damaged in transit, or not as described, please contact us within 48 hours of delivery with clear photographs, and we will offer a repair, replacement (where the design allows) or refund as appropriate.
For Custom Set and Solid Custom Colour orders, you are responsible for providing accurate nail measurements or sizing information via WhatsApp. We paint to the sizing you provide. If a set does not fit because incorrect measurements were given, we're happy to discuss a replacement, but this will not be treated as a fault and any reprint may be chargeable to cover materials and time.
Press-on nails involve adhesives and painted materials which, as with any cosmetic product, can occasionally cause a reaction in people with sensitive skin or specific allergies. We recommend carrying out a small patch test before full application if you have any known sensitivities. We are not responsible for reactions arising from failure to patch test, from misuse, or from use of adhesives not supplied by us. This does not affect any liability we cannot lawfully exclude, including for defective products under the Consumer Protection Act 1987.
We reserve the right to decline, cancel or refund any order at our discretion before work begins — for example where a requested design is inappropriate, infringes someone else's copyright or trademark, or where a customer is abusive or threatening towards us. Where we cancel an order under this clause before painting has begun, you will receive a full refund.
We may photograph finished sets (the nails themselves, not identifiable photos of you) for use in our marketing, on the Site, and on our Facebook, Instagram and TikTok pages. If you send us a photo of yourself wearing your set and are happy for us to share it, we will always ask before posting it publicly with any identifying detail.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under English law. Subject to that, our liability to you for any order is limited to the price you paid for that order.
These Terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
